Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Viaduco mobile application (the "App"), developed and operated by Engly Inc. ("Company," "we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms
By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
3. WHAT VIADUCO IS — AND WHAT IT IS NOT
We built Viaduco to make evidence-based mental wellness tools more accessible. That said, it's important you understand what the App can and cannot do.
3.1. A Wellness Tool, Not a Healthcare Provider. Engly Inc. is a technology company. The App provides self-guided exercises and content informed by evidence-based psychological frameworks, including Cognitive Behavioral Therapy (CBT). It is designed for informational, educational, and self-reflective purposes only. It does not provide medical advice, clinical diagnosis, psychiatric care, psychotherapy, counseling, or any other form of professional healthcare service.
3.2. No Therapist-Patient Relationship. Using the App does not create a therapist-patient, doctor-patient, counselor-client, or any other healthcare provider relationship between you and Engly Inc. or any of its employees, officers, or affiliates.
3.3. Not a Substitute for Professional Care. The App is not a replacement for working with a licensed mental health professional. Please do not use the App as a substitute for professional consultation, and do not delay seeking care, disregard professional advice, or discontinue treatment based on anything you encounter in the App.
3.4. No Guarantees of Outcomes. Everyone's experience is different. We cannot and do not guarantee that using the App will improve your mental health or well-being. The App is not designed to treat, cure, prevent, or mitigate any disease, disorder, or condition.
3.5. Your Responsibility. Any decisions you make based on content, exercises, or suggestions in the App are your own. We encourage you to use the App as one part of a broader approach to your well-being — not as your only resource.
3.6. Artificial Intelligence Disclosure. The App uses artificial intelligence ("AI") technology, including large language models. When you interact with the App, you are interacting with software, not a human being. AI is a developing technology. Despite our efforts to implement reasonable safety controls, the App may occasionally produce responses that are inaccurate, incomplete, or not well-suited to your situation. AI does not replace human judgment and is intended solely as a self-guided support tool.
4. IF YOU ARE IN CRISIS, PLEASE SEEK HELP
4.1. This App Is Not for Emergencies. Viaduco is not equipped to help with mental health crises, including but not limited to suicidal thoughts, self-harm, thoughts of harming others, abuse, psychosis, severe mental health conditions, or medical emergencies. If you are experiencing any of these, please stop using the App and reach out to someone who can help right away:

4.2. No Real-Time Monitoring. The App does not monitor your inputs or usage in real time. No human reviews what you enter. There is no mechanism in the App to detect a crisis or to contact emergency services on your behalf.
5. Understanding the Risks
You acknowledge that using any self-guided wellness tool involves inherent limitations. While we work hard to make the App helpful and safe, you understand that the App may not be appropriate for everyone, and you use it at your own discretion and risk.
6. User Responsibilities
6.1. Respectful Use. You agree not to: (a) use the App for any unlawful, harmful, or misleading purpose; (b) attempt to gain unauthorized access to any part of the App or its systems; (c) use the App in a way that could disrupt or impair its functionality; (d) reverse-engineer, decompile, or disassemble any part of the App; or (e) use the App to develop a competing product or service.
6.2. Account Security. You are responsible for keeping your account credentials confidential and for any activity that occurs under your account.
7. Termination
We may suspend or terminate your access to the App at any time if we believe you have violated these Terms or misused the App. Upon termination, your license to use the App ends and you should delete the App from your devices.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, ENGLY INC. DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT PROVIDED THROUGH THE APP WILL BE ACCURATE, COMPLETE, OR RELIABLE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENGLY INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR DATA — ARISING FROM OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY CONTENT, TOOLS, OR INFORMATION PROVIDED THROUGH THE APP; (C) ANY MENTAL, EMOTIONAL, OR PHYSICAL HARM EXPERIENCED DURING OR AFTER USING THE APP; OR (D) ANY OTHER MATTER RELATED TO THE APP, REGARDLESS OF THE THEORY OF LIABILITY.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100.00).
10. Indemnification
You agree to indemnify and hold harmless Engly Inc., its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use or misuse of the App; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.
11. Dispute Resolution
11.1. Informal Resolution First. We'd like to resolve any disputes amicably. Before filing a formal claim, you agree to contact us at support@viadu.co and give us 60 days to try to resolve the matter informally.
11.2. Arbitration. If we can't resolve a dispute informally, you and Engly Inc. agree to resolve it through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in New Castle County, Delaware, unless we agree otherwise. Either party may bring qualifying claims in small claims court instead.
11.3. No Class Actions. You and Engly Inc. agree to bring any disputes only in an individual capacity. Neither party may participate as a plaintiff or class member in any class, consolidated, or representative proceeding.
11.4. Opt-Out. You may opt out of arbitration by emailing support@viadu.co within 30 days of first accepting these Terms, with your name, address, and a clear statement that you wish to opt out.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted in the App, and the updated version takes effect upon posting. If we make material changes, we will make reasonable efforts to notify you. Continued use of the App after changes means you accept the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware and applicable federal law, without regard to conflict of law principles. To the extent litigation is permitted, you consent to the exclusive jurisdiction of the courts in New Castle County, Delaware.
14. Severability
If any part of these Terms is found unenforceable, the remaining provisions continue in full force. The unenforceable provision will be modified to the minimum extent needed to make it valid.
15. Entire Agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and Engly Inc. regarding the App.
